Nothing in these Terms purports to modify or exclude those statutory guarantees, including your rights to a refund, repair, or replacement for major failures, or compensation for reasonably foreseeable loss or damage. However, to the extent permitted by law, our liability for breach of any condition, warranty, or guarantee is limited to the resupply of services or the cost of having those services resupplied. If your rental is through a third-party Rental Company, that company may also be responsible for honoring any applicable consumer guarantees under local law.
Brazil – Consumer and Contractual ProtectionsIf you are a resident of Brazil, you are protected under
Brazil’s Consumer Protection Code (Law No. 8,078/1990). These Terms do not exclude any mandatory consumer rights granted under Brazilian law. Contracts entered into electronically are valid and enforceable under
Law No. 14,063/2020 and
Provisional Measure No. 2,200-2/2001 (regarding digital signatures and electronic records). Refunds, cancellations, and cross-border payment arrangements will comply with applicable currency, tax, and digital contracting laws where required.
Switzerland – Exclusion of Swiss Law Mandatory Jurisdiction ClauseTo the extent permitted by Swiss law, Swiss users acknowledge and accept that while local mandatory consumer protections apply, they agree that disputes shall be subject to Delaware jurisdiction unless prohibited by Swiss Federal Act on Private International Law.
